These General Terms and Conditions (GTC) apply to webdesign provided by bubu IT. Deviations from these agreements require the written consent of both contracting parties.

Subject of the Contract

The Contractor provides web design services in accordance with individual agreements with the customer. This includes the conception, design, and development of the website, as well as the integration of content and features.

Concept and Time Estimation

The Contractor requires the Client to provide a detailed concept outlining the desired content, features, and design of the website. Based on this concept, the Contractor creates a time estimation for each individual aspect, section, or area of the project. The time estimation serves as the basis for calculating the overall effort and costs.

Offer 

The Contractor provides the Client with a written offer that details the individual services, scope, costs, and project timeframe. 

Advance Payment

  1. Payment Terms: The client is obligated to make the agreed payment in advance. Services will only be initiated upon successful receipt of the payment to the designated bank account, as specified in the invoice.
  2. Payment Methods: The client may make the payment via bank transfer to the provided account. Additional payment methods may be accepted upon prior arrangement.
  3. Payment Deadline: Payment must be made within 8 days from the date of receiving the invoice, unless otherwise specified in the invoice with different payment terms.
  4. Commencement of Services: The services, as described in the proposal or agreement, will commence immediately following the successful receipt of the payment.

Changes and Extensions

Changes and extensions to the concept or requirements by the Client after work has commenced may result in additional costs and an extension of the project timeline. The Contractor will inform the Client about such changes in a timely manner and provide a corresponding offer for the additional services.

Copyright and Usage Rights

The Contractor retains the copyright to all design elements, graphics, code, and content created by them, unless expressly agreed otherwise. The Client is granted a non-exclusive, non-transferable right to use the created website for their own business purposes.

Liability and Warranty

The Contractor is liable for damages caused by gross negligence or intent. Any further liability is excluded. The Contractor does not provide a warranty for the error-free and uninterrupted availability of the website, as this is dependent on external factors.

Data Confidentiality

The contractor treats all customer data transmitted within the project with the utmost confidentiality and commits to complying with all applicable data protection regulations, especially the General Data Protection Regulation (GDPR). Customer data collected, processed, or transmitted during the course of the project adheres to the highest security standards. This data is used exclusively for the purpose of the project and will not be disclosed to third parties unless explicitly authorized by the customer or legally required.

Confidentiality extends beyond the project's duration and remains in effect even after the project's completion. The contractor undertakes to adequately protect customer data and take appropriate measures to prevent unauthorized access, loss, theft, or disclosure.

Registration and Conclusion of Contract

Registration for an online course is done by filling out the registration form on the Provider's website. The contract is concluded when the Provider confirms the registration, and the participant has paid the course fee.

Course Fee and Payment Conditions

The course fee for the online course is specified on the Provider's website and is in Euros, including the applicable value-added tax. Payment is made in advance via bank transfer.

Access to the Online Course

After receipt of payment, the participant receives access credentials for the online course. These access credentials are personal and may not be shared with third parties. The participant is responsible for the security of their access credentials and is liable for all activities conducted using their access credentials.

Scope of the Online Course

The Provider offers the agreed-upon online course, including access to learning materials, videos, online forums, and potentially participation in live webinars. The Provider reserves the right to adjust or expand the scope of the course, as long as it serves the overall purpose of the course.

Recording Prohibition

It is strictly prohibited to conduct any form of audio or video recordings, transcripts, or screen recordings during our courses or training sessions unless explicit written permission has been granted.

By participating in our courses, you expressly agree to respect and adhere to these recording prohibitions. Violations of this provision may result in the immediate termination of your participation in a course and may potentially have legal consequences.

This measure is in place to protect privacy and intellectual property, ensuring that all our courses can take place in a trustworthy and respectful environment.

Right of Withdrawal

The participant has a right of withdrawal in accordance with legal regulations. The withdrawal must be made in writing within the statutory period. Details regarding the right of withdrawal are provided on the Provider's website or in the course description.

Disclaimer

The Provider assumes no liability for the accuracy, completeness, or timeliness of the information conveyed in the online course. Participation in the online course is at the participant's own risk. The Provider is not liable for damages resulting from the application of course content.

Copyright and Usage Rights

All materials and content provided in the online course are protected by copyright. The participant receives only a non-exclusive, non-transferable right to use the course materials for personal purposes. Reproduction, distribution, or public reproduction of course content is prohibited without the prior written consent of the Provider.

Data Protection

The Provider is committed to complying with data protection regulations. Participant data is used only for the purpose of contract processing and course execution. Further information on data protection can be found in the Provider's privacy policy.

Final Provisions

Changes or additions to these GTC require written form. Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. Austrian law applies. Place of performance and exclusive place of jurisdiction is the registered office of the Provider.
